OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck- by and crushing hazard: a) Freezer and chill room warehouse: On January 11, 2013 and at times prior thereto the industrial storage rack system in use was not properly maintained in that columns and base plates had visible damage, not all base plates were in place, and not all of the columns were secured to the floor. This exposed employees to a struck-by or crushing hazard from the stored product falling in the event the rack system is struck with force causing movement and potential failure. Note) Abatement certification IS required for this item.

The cabinet doors on the compressor motor control center were open and unsecured. Note) Abatement certification IS required for this item.
