29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) Worksite, 1170 Atlantic Ave., Baldwin, NY- Six employees working at the edge of a 4-12 pitch commercial roof approximately 14 feet above the ground were not protected by a guardrail system, safety net system or a complete fall arrest system; on or about 12/17/12. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: Worksite- 1170 Atlantic Ave., Baldwin, NY- Six employees were working at the edge of a 4-12 pitch commercial roof at a height of approximately 14 feet above the ground. They did not have fall protection and were not provided with a training program on the recognition of fall hazards and the appropriate means to minimize the hazard; on or about 12/17/12. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
