29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (Construction Reference 1926.103) (a) Sorrento Lactalis, new fresh mozzarella plant, on or about 01/11/2013, and at times prior thereto, employees were exposed to the dust hazards (31-51% crystalline silica) from work on vitrified ceramic tile flooring and grout. Employees were provided with N95 type dust masks, but had not been adequately trained. Note: Abatement certification is required for this item.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminants chemical state and physical form: (Construction Reference 1926.103) (a) Sorrento Lactalis, Fresh Mozzarella Plant, on or about January 11, 2013, and at times prior thereto, employees were exposed to the hazards of floor dust (31-51% crystalline silica) from work on vitrified ceramic tile flooring and grout. Dust became airborne by dry sweeping and using portable vacuums without high efficiency filters. No air monitoring was conducted to fully identify the hazards. Note: Abatement certification is required for this item.
