29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) Near the intersection of Austin Road and Chickamauga Street, on Fort Stewart, GA - On or about, and at times prior to January 10, 2013, employees were allowed to work in trench with miscellaneous tools, equipment, and spoil piles that were less than 2 feet of the open trench, thus exposing employees to cave-in and struck-by hazards. ABATEMENT CERTIFICATION IS NOT REQUIRED

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) Near the intersection of Austin Road and Chickamauga Street, on Fort Stewart, GA on or about January 9, 2013, the foreman and the superintendent accessed and performed work in a 8.5 foot deep trench without cave-in protection, thus exposing the employees to struck-by, and cave-in hazards. b) Near the intersection of Austin Road and Chickamauga Street, on Fort Stewart, GA on or about January 10, 2013, employees were allowed to access and perform work in a 5 to 7 foot deep trench without cave in protection, thus exposing the employees to struck-by, and cave-in hazards. ABATEMENT CERTIFICATION IS NOT REQUIRED
