29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) construction site of new VA Behavioral Health Clinic, 135 E. 38th St., Erie, PA, east of building. On or about January 11, 2013, personnel were in an excavation that was 10-feet in depth while conducting work activities that included but were not limited to installing steam lines. The sloping/benching protective system was inadequate in that the excavation was not sloped/benched properly for a Type B soil. The excavation was sloped/benched back to horizontal distance of only 6.4 feet.

29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirements of paragraphs (b)(1), (b)(2), (b)(3) or (b)(4): a) construction site of new VA Behavioral Health Clinic, 135 E. 38th St., Erie, PA, east of building. On or about January 11, 2013, personnel were in an excavation that was 10-feet in depth while conducting work activities that included but were not limited to installing steam lines. The sloping/benching protective system was not constructed in accordance with the 29 CFR 1926.652(b)(1) through 29 CFR 1926.652(b)(4) in that the excavation was not sloped/benched properly for a Type B soil. The excavation was sloped/benched back to horizontal distance of only 6.4 feet.
