OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees used forklift to elevate personnel:    (a) Warehouse 1: on 01/07/13 and at times prior thereto, workers accessed long-term storage areas at least 10 feet 3 inches high while being supported by a shop-made flat pallet without guardrails, mid-rails and toe-boards which was not secured to the H35XL Hyster forklift.    NOTE:  Abatement certification IS required for this item.

29 CFR 1910.23(c)(1):     Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:    (a) Warehouse 1 mezzanine storage areas: On 1/7/13 and at times prior thereto, workers were able to access a 9' mezzanine that did not have standard railings or another method of fall protection.    Note 1:  Railings shall have toeboards when beneath the open sides, persons can pass, there is moving machinery, or there is equipment with which falling materials could create a hazard.    Note 2: Abatement certification IS required for this item.

29 CFR 1910.27(c)(4):     The employer did not install fixed ladders with at least 7 inches of clearance from the centerline of the rung to the nearest permanent object in the back of the ladder.    (a) Warehouse 1: on 1/7/12 and at times prior thereto, a fixed ladder constructed of 2X4 lumber does not have adequate clearance from the wall to the centerline of the rung.    Note 1: Abatement certification IS required for this item.    Note 2: Figure D-3 of 29 CFR 1910.27 provides guidance for constructing fixed ladders.
