29 CFR 1910.132(a):  Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    a)  Mistras Group, Inc. at 5801 Brighton Blvd., Commerce City, CO 80022:  On or before October 29, 2012, the employer did not ensure that the proper personal fall arrest systems were provided and used when employees were working in the Heater 401 in the following instances:    1)  The employer did not provide an approved anchorage point that would support up to 5,000 pounds; and     2)  The employer did not provide the proper lanyard for use by employees who required the mobility to move to the pipes being imaged, and then to move away from the radioactive imaging source.  The employer provided a double 6' shock absorbing lanyard for use, but this lanyard did not provide the mobility required for the task.    Conditions exposed employees who were inspecting the pipes to fall hazards of up to 25 feet.                                                       Or In The Alternative    29 CFR 1910.146(d)(4)(iv): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), in so far as feasible engineering and work practice controls did not adequately protect employees, the employer did not provide and ensure the proper use of personal protective equipment:    a)  Mistras Group, Inc. at 5801 Brighton Blvd., Commerce City, CO 80022:  On or before October 29, 2012, the employer did not ensure that the proper personal fall arrest systems were provided and used when employees were working in the Heater 401.  Conditions exposed employees who were inspecting the pipes to fall hazards of up to 25 feet.

29 CFR 1910.146(f):  The entry permit that documented compliance with this section and authorized entry into a permit space did not identify the requirements in (f)(1)-(15) of this section:    a)  Mistras Group, Inc. at 5801 Brighton Blvd., Commerce City, CO 80022:  On or before October 29, 2012, the entry permits used by Mistras to enter into Heater 401 did not identify the requirements of (f)(1) - (f)(15) in the following instances:    1)  the authorized entrants within the permit space (permits # DN1-0000333920 and # DN1-0000334553);    2)  the personnel, by name, currently serving as attendants (permits # DN1-0000333124, DN1-0000333920, and # DN1-0000334553);    3)  the entry supervisor by name, with a space for the signature or initials of the entry supervisor who initially authorized entry (all permits);    4)  the hazards of the permit space to be entered (all permits);    5)  the measures used to isolate the permit space and to eliminate or control permit space hazards before entry (all permits);    6)  the acceptable entry conditions (all permits);    7)  the results of the initial and periodic air monitoring tests, performed under (d)(5) of this section, accompanied by the names or initials of the testers and by an indication of when the tests were performed (all permits);    8)  the communication procedures used by the authorized entrants and attendants to maintain contact during entry (all permits); and    9)  equipment, such as personal protective equipment, testing equipment, communications equipment, alarm systems, and rescue equipment to be provided for compliance with this section:         a)     Permit # DN1-0000333124 for Heater 401 dated October 25, 2012 showed N/A for  Rescue/Fall Protection;          b)     Permit # DN1-0000333920 for Heater 401 dated October 26, 2012 showed N/A for  Rescue/Fall Protection;          c)     Permit # DN1-0000334553 for Heater 401 dated October 27, 2012 showed N/A for  Rescue/Fall Protection; and           d)     Permit #DN1-0000335606 for Heater 401 dated October 29, 2012 showed N/A for  Rescue/Fall Protection.     Conditions exposed employees to fall hazards of up to 25 feet.
