29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Maintenance Area: On or about April 4, 2013, and at times prior thereto, a Monarch horizontal lathe was not equipped with a fixed or movable guard to protect the operator against contact with the rotating lathe chuck. b) Maintenance Area: On or about April 4, 2013, and at times prior thereto, a Birmingham Vertical Mill Machine was not equipped with a chip guard to protect the employee against the hazards of flying projectiles.

29 CFR 1910.95(i)(5): The employer did not ensure proper initial fitting and supervise the correct use of all hearing protectors: At the inspection site, where employees were exposed to noise levels at or above an 8-hour Time-Weighted Average (TWA) of 85 decibels while engaged in production of open head and tight head pails, at least 2 employees were providing their own hearing protection because earplugs provided by the employer were too small.
