OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crushed by hazards.    On or about January 15, 2013, and at times prior thereto, the employer did not ensure that frequent and periodic inspections of the hoists were being performed:    a) In the wax injection room, employees operated a 1 ton DEMAG crane and components hoist  b) In the shell department, employees operated two 1 ton R&M Loadmate LM10 hoists
