29 CFR 1926.451(e)(9)(iv): The employer did not ensure that cross braces were not used as a means of access or egress: (a) Winter Brothers, Inc. @ 2828 Bryant St., Denver, CO 80211: On 1/16/13, the employer did not ensure that the southeast fabricated frame scaffold was equipped with ladder access to the platform on the working level. An employee used the cross bracing on the first scaffold level to access and egress the working platform on the second level and was therefore, exposed to a fall hazard of approximately 14.5 ft. Winter Brothers, Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard (29 CFR 1926.451(e)(9)(iv)), which was contained in OSHA Inspection (310596150), Citation Number 1, Item Number 1, issued on 4/11/08, with respect to a workplace located at 2043 & 2055 Avery Way, Castle Rock, CO 80104.

An employee worked from the second level of the scaffold that was equipped with 2, rather than 3, 2x10 in. wooden planks. An employee used a 4.5 in. angle grinder to create expansion joints on the exterior of the commercial building and was exposed to a fall hazard of approximately 14.5 ft.
