29 CFR 1926.651(k)(1):     An Inspection of the excavation, adjacent areas, and protective systems by a competent person was not accomplished prior to the start of work and as needed throughout the shift:                                                                         On the North West corner of the building located at 1030 Southern Hills Dr. Hastings, NE, 68901 - Employer failed to conduct an inspection prior to starting work when employees were to enter the trench.  This inspection includes but is not limited to clarifying the soil to determine the appropriate protective system for the excavation; design a ramp or provide a ladder for access and egress;  determine cave-in potential to decide whether shoring or other protective systems are needed.

This failure has the potential to expose employees to injuries associated with working with chemicals such as but not limited to Bill PR-3 that they are not familiar with and are not trained to use. The lack of a ladder or other means of egress exposed the employees to sloughing or cave in hazards.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal):            North West Corner 1030 Southern Hills Dr. Hastings, NE, 68901 - Employer failed to ensure that employees are not working in an excavation that was not sloped at an angel of 34 degrees or provided with an adequate protective system. The lack of sloping or a protective system exposed the employees to sloughing and cave in hazards.
