29 CFR 1926.200(g)(1): Construction areas were not posted with legible traffic signs at points of hazard.    a) The violation was observed on January 16, 2013, on the northbound lane of Menard Ave., where the employer did not provide advanced warning to road users that road work (not short duration or mobile) was taking place or what actions the road user must have taken to drive through the work zone, as required by the MUTCD Section 6G.03. Thereby exposing employees in the work zone to struck-by hazards.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.651(d): Employees exposed to public vehicular traffic were not wearing warning vests provided by the employer:    a) Employees exposed to public vehicular traffic were not wearing high visibility apparel.    Ted Kawula Company, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(d) which was contained in OSHA violation number 97900, citation 1, item 2, issued on September 23, 2011 and became final order on or about October 5, 2011 with respect to a workplace located at 2734 N. Lincoln Ave. Chicago, IL. 60614.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures:    a)  Employees were exposed to the hazard of being struck by concrete and soil while working in a trench approximately 5.5 feet deep where a section of the street was undermined and had not been protected from collapse by a support system or another system.     Ted Kawula Company, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(d) which was contained in OSHA violation number 97900, citation 1, item 3, issued on September 23, 2011 and became final order on or about October 5, 2011 with respect to a workplace located at 2734 N. Lincoln Ave. Chicago, IL. 60614.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
