29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered The employer does not ensure that protective equipment was being used by employees and in good working condition. This violation was observed on or about January 16, 2013, in the warehouse area where an employee was operating a Toyota forklift (Unit 4) and not wearing the supplied seatbelt due to it was inoperable. This condition exposed the employee to a struck-by hazard. Pursuant to 29 C.F.R. 1903.19, within 10 (ten) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from struck-by hazards.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: The employer does not provide suitable facilities for quick drenching or flushing for the eyes or body where employees are using corrosive chemicals. This violation was observed on or about January 16, 2013, in manufacturing warehouse where employees were exposed to chemicals burn hazards by using Muriatic Acid and Liquid Soldering Fluxes (corrosive) without an immediate emergency eyewash or body drenching facilities within the work area. Pursuant to 29 C.F.R. 1903.19, within 10 (ten) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees have access to facilities for quick drenching or flushing of the eyes and body.

This violation was observed on or about January 16, 2013, Work Center #2064 where employees were exposed to electrical and fire hazards when Breaker Box #5 and Disconnect #6 was blocked by a wooden 12 foot work table and a 5 tier metal storage shelf which disallowed access. d. This violation was observed on or about January 16, 2013, Maintenance Department where employees were exposed to electrical and fire hazards when Breaker Panel Labeled HA-1 was blocked by storage of brooms and a Miller welding machine with a Argon Gas cylinder which disallowed access. e. This violation was observed on or about January 16, 2013, Maintenance Department where employees were exposed to electrical and fire hazards when accessing Breaker Box #29 that was blocked by 8 Tier Metal Storage Shelf and a Safety Kleen Parts Cleaning Station which disallowed access. Pursuant to 29 C.F.R. 1903.19, within 10 (ten) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees have ready access to electrical devices to protect employees from electrical and fire hazards.
