OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the smoke inhalation hazards: On or about January 18, 2013: Employees, working in the kitchen area, were exposed to smoke inhalation while using the broiler. The employer failed to ensure the exhaust hood was in good operating condition. A feasible and acceptable method of abatement to correct this hazard is to ensure proper maintenance and repairs are performed at intervals necessary to maintain required airflow as required by NFPA 96 Standard for Ventilation Control and Fire Protection of Commercial Cooking Operations.
