OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the smoke inhalation hazards:    On or about January 18, 2013:    Employees, working in the kitchen area, were exposed to smoke inhalation while using the broiler.  The employer failed to ensure the exhaust hood was in good operating condition.    A feasible and acceptable method of abatement to correct this hazard is to ensure proper maintenance and repairs are performed at intervals necessary to maintain required airflow as required by NFPA 96 Standard for Ventilation Control and Fire Protection of Commercial Cooking Operations.

29 CFR 1910.141(a)(3)(ii):     Floor(s) of workroom(s) were not maintained, so far as practical, in a dry condition:    On or about January 18, 2013:    Employees, working in the kitchen area, were exposed to slip, trip, and fall hazards from rain puddles and buckets placed on the kitchen floor due to a leaking roof.  The employer failed to ensure the floor was maintained in a dry condition.

29 CFR 1910.1200(h)(2)(iii):     The employer did not provide information to the employees as to the location and availability of the written hazard communication program, and material safety data sheets required by 29 CFR 1910.1200:    On or about January 18, 2013:    Employees cleaning the kitchen area were exposed to inhalation and skin contact hazards while using chemicals such as cleaners and degreasers.  The employer did not ensure all employees were informed of the location of the material safety data sheets.
