29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):     a.   On or about January 18, 2013, at the above addressed job site, employees were exposed to struck-by hazards while unloading double stacked crates with a powered industrial truck that had been operated by an employee who had not been trained in safe operating procedures.

On or about January 18, 2013, at the above addressed job site, an employee was exposed to a struck-by hazard and was injured by a cargo crate that had fallen while it was being unloaded by a powered industrial truck.
