29 CFR 1926.102(a)(1):     Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    On or about January 17, 2013, at the job site located at 4923 Camp Robinson in North Little Rock Arkansas the employer did not ensure the employee using the nail gun was protected by the use of protective eyewear.  The employer actively used the nail gun on the day of this inspection while installing shingles on the roof of the dwelling.  This condition exposed the employee to serious eye injuries.

29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b).    On or about January 17, 2013, the employer did not ensure that each employee working and walking on a steep roof, with unprotected sides and edges were protected from falling approximately 9-15 feet by a fall protection system.  The roof pitch measures approximately 6:12.  Alternative fall protection system use not attempted.  Employee was exposed to fall hazards while performing roofing activities assigned by the employer.
