29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: a) An employee, (Welder) while TIG welding MuMetal, was provided and voluntarily donned a half face tight-fitting elastomeric North 7700 30M respirator. The employee did not develop a written respiratory protection program to ensure that the employees were not exposed to health hazards associated with the respirator. On or about February 6, 2013. b) An employee, (Finisher) while spraying Permalac Clearcoat onto manufactured metal products, was provided with and voluntarily wore a half face tight-fitting elastomeric 3M 7503 respirator. The employer did not develop a written respiratory protection program to ensure that the employees were not exposed to health hazards associated with the use of the respirator. On or about February 6, 2013.

The employer did not provide the employee with a medical evaluation to ensure that the employee was medically fit to wear the respirator. 29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or were not packed or stored to prevent deformation of the facepiece and exhalation valve: a) An employee, (Welder) while TIG welding MuMetal, was provided and voluntarily donned a half face tight-fitting elastomeric North 7700 30M respirator. The employer did not ensure that the respirator was stored appropriately as the employee left the respirator lying uncovered on the workbench when not in use. On or about February 6, 2013. b) An employee, (Finisher) while spraying Permalac Clearcoat onto manufactured metal products, was provided with and voluntarily wore a half face tight-fitting elastomeric 3M 7503 respirator. The employer did not ensure that the respirator was stored appropriately as the employee left the respirator uncovered on top of rags in the finishing area where hoses were used to remove chemicals from metal products. On or about February 6, 2013.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: a) Amuneal Manufacturing, Inc.: Employees (Welders and Grinders) voluntarily donned 3M 8511 N95 filtering facepiece respirators while welding and grinding on metals. The employer did not provide the employees with the information found in Appendix D of the respiratory protection standard. On or about February 6, 2013.
