29 CFR 1910.1050(i)(1): Where employees were subject to dermal exposure to methylenedianiline, where liquids containing methylenedianiline could have been splashed into the eyes, or where airborne concentration of methylenedianiline were in excess of the PEL, the employer did not ensure the employee used the appropriate protective work clothing and equipment to prevent contact with methylenedianiline: On or around January 15, 2013 the employer did not ensure employees used the appropriate work clothing and equipment to prevent contact with methylenedianiline (MDA) when a large release occurred from process piping in the MDA tank farm area of its Baytown facility and MDA was carried outside the established regulated area.

This condition most recently occurred when the employer did not promptly act to repair a leak on an MDA discharge piping product loop following detection on or around January 03, 2013: This condition most recently occurred when the employer did not promptly act to clean up MDA following a release that occurred on or around January 15, 2013 that caused MDA to be strewn into unregulated areas of the facility. The impacted areas were not declared regulated areas and the MDA in the unregulated areas was not cleaned up.

29 CFR 1910.1050(d)(2): Means were not implemented to promptly alert those employees who had the potential to be directly exposed to methylenedianiline in the event of an emergency: On or about January 15, 2013, at the Bayer MaterialScience facility in Baytown, Texas the employer failed to alert employees and did not declare an emergency when a flange in the process piping of the MDA loading loop, which was in MDA service, failed to keep containment and released more than 10,000 pounds of MDA. MDA was released to areas outside of the permanently regulated area of the MDA tank farm.
