29 CFR 1926.501(b)(3): "Hoist areas." Each employee in a hoist area shall be protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems or personal fall arrest systems. If guardrail systems, [or chain, gate, or guardrail] or portions thereof, are removed to facilitate the hoisting operation (e.g., during landing of materials), and an employee must lean through the access opening or out over the edge of the access opening (to receive or guide equipment and materials, for example), that employee shall be protected from fall hazards by a personal fall arrest system. (a). Worksite located at 450 68th Street, Gladstone, Missouri- Employees were exposed to fall hazards while working in and around hoisting areas on the roof and could be knocked off the roof by the suspended loads and were not using any means of fall protection.

29 CFR 1926.1501(a)(5): The employer shall designate a competent person who shall inspect all machinery and equipment prior to each use, and during use, to make sure it is in safe operating condition. Any deficiencies shall be repaired, or defective parts replaced, before continued use. (a). Worksite located at 450 68th Street, Gladstone, Missouri- Employees were exposed to struck-by hazards in that the spring-loaded safety latch on the hook of the lift had been removed. (b). Worksite located at 450 68th Street, Gladstone, Missouri- Employees were exposed to sturck-by hazards or crane collapse hazards in that the footings being used to support the outriggers were not sufficient to support this machine.

29 CFR 1926.1501(a)(6): A thorough, annual inspection of the hoisting machinery shall be made by a competent person, or by a government or private agency recognized by the U.S. Department of Labor. The employer shall maintain a record of the dates and results of inspections for each hoisting machine and piece of equipment. (a).
