OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a. North side of building - employees were exposed to a 15 ft fall hazard, in that, a fiberglass portable ladder was used to gain access to a roof and the ladder side rails did not extend at least 3 feet above the upper landing surface. The ladder was approximately 18" above the roof landing. Violation observed on or about 01/22/13.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent). a. At the site - employees were exposed to a 15 ft fall hazard, in that, fall protection was not provided while working near the roof edge. Employees were screwing and installing the roof caps for the ballasts. Violation observed on or about 01/22/13.
