The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.    a. On or about September 24, 2012, at the above addressed jobsite, the employees entering the crawl space were not provided with medical evaluations when required to wear tight fitting N95 respirators, thereby exposing employees to the hazards associated with respirator use.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:    a.  On or about September 24, 2012, at the above addressed jobsite, employees were required to work with chemicals including, but not limited to Brass O, paint thinner, and boiler treatment.  The employer had not developed and implemented a written hazard communication program including, but not limited to labeling, material safety data sheets and training programs.

Employers and building and facility owners shall exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of ACM and PACM.    a.  On or about September 24, 2013, at the above addressed jobsite, employees were entering crawl spaces with disturbed asbestos containing materials.  The employer did not determine the presence, locations and quantity of asbestos containing materials, thereby exposing the employees to the hazards associated with asbestos.

29 CFR 1910.1001(j)(7)(iv): The employer shall also provide, at no cost to employees who perform housekeeping operations in an area which contains ACM or PACM, an asbestos awareness training course, which shall at a minimum contain the following elements: health effects of asbestos, locations of ACM and PACM in the building/facility, recognition of ACM and PACM damage and deterioration, requirements in this standard relating to housekeeping, and proper response to fiber release episodes, to all employees who perform housekeeping work in areas where ACM and/or PACM is present. Each such employee shall be so trained at least once a year.    a.  On or about September 24, 2012, at the above addressed jobsite, employees required to enter crawl spaces which contained damaged asbestos were not provided with asbestos training, employees were thereby exposed to the hazards associated with asbestos.

On or about September 24, 2012, at the above addressed jobsite, employees were entering into crawl spaces which contained damaged asbestos materials and accompanying dust.  The employer failed to maintain the area as free as practicable of ACM waste and debris, thereby exposing employees to the hazards associated with asbestos.
