29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing hazardous conditions and the deficient actions). On or about January 24, 2013, where workers were exposed to hazards during residential construction activities, the employer did not conduct frequent inspections to ensure that any laborer employed in the performance of the contract did not work in the surroundings or under working conditions which were unsatisfactory, hazardous or dangerous to the employees health and safety: a) At 2009 Montecito trail, where masonry workers were exposed to fall hazards and struck by hazards while working on and around scaffolding. b) At 2101 Palomar trail, where roofing workers were performing roofing activities from the roof and masonry workers were performing masonry activities on and around scaffolding and exposed to fall hazards and struck by hazards.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: On or about January 24, 2013, an employee was not wearing a protective hard hat while walking and working under employees working at upper levels with tools, bricks, stone and roofing materials. The employee was exposed to the hazard of head injuries/being struck by flying or falling objects: a) At a residential home on 2009 Montecito trail b) At a residential home on 2101 Palomar trail
