29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On or about 1/17/13 at the Orchard Fresh Store located at 4050 North Buffalo Road, Orchard Park, New York; an employee assembling a commercial oven was working from the top of the oven. The employee was exposed to a fall of approximately 9 feet to the floor. NO ABATEMENT CERTIFICATION REQUIRED

Employees were not trained in identifying fall hazards, eliminating fall hazards, or the requirments for fall protection. NO ABATEMENT CERTIFICATION REQUIRED
