29 CFR 1910.178(p)(1):     Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s).    On or about 23 January 2013, and at times prior thereto, thirteen (13) Toyota LPG Forklifts utilized at the work site by the truck drivers did not have back up alarms, and instead, operators used the horns and reverse LED lights would come on. Due to the forklift traffic and pedestrian traffic in the same areas at times, near misses occurred, exposing the employees to a struck by hazard from the forklift.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure back up alarms are installed to eliminate the need for human interaction in sounding the horn when operating the forklift in reverse.

29 CFR 1904.29(b)(1):     A Log of all recordable work-related injuries and illnesses (OSHA Form 300 or equivalent) was not completed in the detail as required by the regulation.    At the inspection site, for calendar years 2009 through 2011, incomplete information for at least 22 cases on the Logs materially impaired understandability of the nature of hazards, injuries and illnesses in the workplace in that the object/substance that directly injured or made person ill was not recorded for those 22 cases.  1) For calendar year 2009, all eight (8) cases except case# EV2009181688 did not have enough explanation in column F of the Log to understand the nature of the injuries.  2) For calendar year 2010, all nine (9) cases except case# EV2010204805 did not have enough explanation in column f of the Log to understand the nature of the injuries.  3) For calendar year 2011, all eight (8) cases except cases# EV2011212772 and EV2011224562 did not have enough explanation in column F of the Log to understand the nature of the injuries.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure the Log is completed in enough detail for understanding the nature of the injuries or illnesses.

29 CFR 1904.33(a):     Basic requirement. The employer did not save the OSHA 300 Log, the privacy case list (if one exists), the annual summary OSHA 300A, and the OSHA 301 Incident Report forms for five (5) years following the end of the calendar year that these records cover.    At the inspection site, for calendar years 2009 through 2011, a certified copy of the OSHA Form 300A Summary of Work-Related Injuries and Illnesses was not retained on file at the premises. Failure to properly certify, maintain, and be able to provide the signed 300A Summary forms is an indication that the OSHA recordable injury and illness history for the recording year may not have been reviewed by the highest management official on site, who is ultimately responsible for preventing employees from being exposed to the same type of injuries and illnesses by ensuring that corrective measures were fully identified during management's evaluation of the accident to prevent similar accidents from happening in the future.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure a signed, certified copy of the OSHA 300A summary is kept on site for a period of five (5) years.
