On or about 01/23/2013, employees were exposed to fall hazards when using a ladder that did not extended 3 feet above the landing surface.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) Location: 92720 Overseas Highway, Tavernier, Florida. On or about 01/23/2013, employees engaged in commercial construction operations were exposed to fall hazards without means of fall protection. REPEAT 1: D.L. PORTER CONSTRUCTORS INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1910.501(b)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 312150535, CITATION NUMBER 1, ITEM NUMBER 2, AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 29, 2008, WITH RESPECT TO A WORKPLACE LOCATED AT 508 SOUTH STREET, KEY WEST, FLORIDA 33311.
