29 CFR 1910.95(g)(1): The employer shall establish and maintain an audiometric testing program as provided in this paragraph by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels. As of and prior to February 5, 2013, the employer had not provided audiometric testing for employees with occupational noise exposure equal to or in excess of an 8-hour time-weighted average (TWA) of 85 decibels: a) An employee operating the "mixer" was exposed to noise at a 68.4 % dose resulting in an 8-hour TWA of 87.3 dBA during a 453 minute sampling period. Zero exposure was assumed for the 27 minutes not sampled. b) An employee operating the "pellet dye" was exposed to noise at an 88.4 % dose resulting in an 8-hour TWA of 89.1 dBA during a 457 minute sampling period. Zero exposure was assumed for the 23 minutes not sampled. Hearing loss is associated with exposure to occupational noise.

29 CFR 1910.272(q)(6)(i): The employer shall equip bucket elevators with a belt alignment monitoring device which will initiate an alarm to employees when the belt is not tracking properly; OR IN THE ALTERNATIVE; 29 CFR 1910.272(q)(6)(ii): The employer shall provide a means to keep the belt tracking properly, such as a system that provides constant alignment adjustment of belts. a.The employer did not equip bucket elevators such as those utilized to provide material for pellet making operations with belt alignment monitoring equipment, or equipment to provide constant alignment adjustment.
