OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards. At this location, employees rode in the cargo area of armored trucks when delivering coins and currency to financial institutions and businesses. Bags and boxes of coins and currency that weighed approximately 25 pounds each were not secured to a permanent structure to prevent the weight shifting in the event of abrupt vehicle movement. The proper securing of cargo is mandated by Part 393-Parts and Accessories Necessary for Safe Operation-Subpart I; Protection against Shifting and Falling Cargo, Federal Motor Carrier Safety Administration-US Dept. of Transportation.
