OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of unintentional start up of metal cutting saws:  American National Standard B11.10-1974--Safety Requirements for the Construction, Care, and Use of Metal Sawing Machines, paragraph 4.2.3.4:  In the event of an interruption in the electrical power supply, the machine shall not restart automatically when power is restored:  National Fire Protection Association 79 - 2002--Electrical Standards for Industrial Machinery, paragraph 7.5.3:  Upon restoration of the voltage or upon switching on the incoming supply, automatic or unintentional restarting of the machine shall be prevented when such a restart can cause a hazardous condition:   (a)  In the Maintenance Shop, the on/off switch for the Wells bandsaw is a push lock in type, which would leave the circuit open in the event of power disruption and the saw could automatically restart with the restoration of the interrupted power supply.  Among other methods, feasible and acceptable abatement means to correct this hazard include, but are not limited to:  (1)  Plug an anti-restart device between the power supply receptacle and the power cord of the band saw.  (2)  Use magnetic motor starter devices to provide anti-restart protection.    DISCLAIMER:  (1)  The employer is not limited to the abatement method(s) suggested by OSHA.  (2)  The employer is responsible for selecting and implementing an effective abatement method.

29 CFR 1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle:    (a)   In the Maintenance Shop, the Wells bandsaw guard was not designed and constructed to protect the operator from unused portions of the blade during operation.

29 CFR 1915.56(b)(1): Arc welding and cutting cables were not completely insulated.    (a)  On the drydock, the arc welding cables for the Big Blue 400D (KF976344) diesel welder were damaged and were not completely insulated.  The welder was used by employees to cut off the old rubber pads at the bow (front) of the Saratoga.

29 CFR 1915.71(j)(3): When rails were omitted, employees working more than 5 feet above solid surfaces were not protected by safety belts and life lines meeting the requirements of  1915.159 and 1915.160:  (a) At the drydock barge,  a five foot scaffold was used by employees to conduct work on the outer hull of the towboat. The end rail was not used as it did not fit under the vessel curvature leaving a gap between the hull of the vessel and the back of the scaffold that exposed employees to a fall hazard of 6 feet.

29 CFR 1915.74(c)(2): A safe walkway meeting the requirements of 29 CFR 1915.74(a)(7) was not provided to step safely to or from the wharf, float, barge, or river towboat.    (a) At the drydock barge, safe access from the concrete pad barge was not provided.  Employees were required to step across a space or gap of approximately 19 inches when accessing the dry dock barge to work on the Saratoga.    (b) At the drydock barge, safe access from the crane barge was not provided.  Employees were required to step across a space or gap of approximately 17 inches when accessing the dry dock barge to work on the Saratoga.
