Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the load should the load slip off the hook, or the lifting device fails:  a)  Pickliq Room, on or about 2/15/13: Two CM 1 ton overhead hoists being used to move bags of sulfate heptahydrate and zinc sulfate heptahydrate were missing the safety latches and not been inspected on a frequent and periodic basis.  Among other methods one feasible and acceptable method to correct this hazard is to:  1.  Install a safety latch on the hook in accordance with ASME B30.16-2007, Section 16-1.2.9.           2.Conduct frequent and periodic inspections of the hoists for wear, deteriorations and malfunction as per ASME B30.16-2007, Section 16-2.

29 CFR 1910.95(c)(1):  A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8 hour time-weighted average sound level (TWA) of 85 dBA:    a) Galvanizing Plant, on or about 2/20/13: An employee working as a Finisher was exposed to continuous noise at a level of 117.3% of the dose of the OSHA permissible exposure limit.  The equivalent dBA for the 1173.3% dose is approximately 91.2 dBA calculated as the 8 hour time weighted sound pressure level. The sampling was conducted on 2/20/13 for 458 minutes.  Exposure calculations include a zero increment for the 22 minutes not sampled. Employee was not wearing ear plugs.       b) Galvanizing Plant, on or about 2/20/13: An employee working as a Finisher was exposed to continuous noise at a level of 98.7% of the dose of the OSHA permissible exposure limit.  The equivalent dBA for the 98.7% dose is approximately 89.9 dBA calculated as the 8 hour time weighted sound pressure level. The sampling was conducted on 2/20/13 for 448 minutes.  Exposure calculations include a zero increment for the 32 minutes not sampled. Employee was not wearing ear plugs.
