29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) On January 24, 2013, at a jobsite located at 1200 N Sioux CT, Independence, MO., an employee working in an excavation approx. 8 ft. in depth was exposed to serious injuries and or death, in that the employee did not recognize and avoid the unsafe conditions relating to the excavation work. The employer did not ensure that a Competent Person capable of recognizing and correcting hazardous conditions was present to take corrective actions and to eliminate the hazards to the employee.
