OSH ACT of 1970 Section (5)(a)(1): 29 CFR Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was allowed to operate a mini-excavator without a roll-over or tip-over protective structure ( ROPS / TOPS ). Jobsite: Basement An employee operated a mini-excavator which was not equipped with a roll-over or tip-over protective structure on uneven soil in the basement.
