29 CFR 1910.67(c)(2)(viii): An aerial lift truck was moved when men were in the basket, in equipment which was not specifically designed for this type of operation in accordance with the provisions of paragraphs (b)(1) and (b)(2) of this section.  On or about January 28, 2013, an employee was riding inside the basket of an ETI articulating boom aerial lift, while the aerial lift truck was moving from a public roadway, around the building, and into the parking lot. This vehicle was not specifically designed for this type of operation and exposed the employee to the hazard of a fall of up to approximately 10 feet.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that aerial lift trucks are not moved while employee(s) is in the basket.

29 CFR 1910.67(c)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift:  On or about January 28, 2013, an employee was working in the elevated basket of an ETI, articulating boom aerial lift and was not wearing a safety harness with lanyard attached to the basket, exposing employee to the hazard of a fall of up to approximately 10 feet.  The HHCC Incorporated was previously cited for a violation of this Occupational Safety and Standard or its equivalent standard 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number: 311315543, Citation Number: 1, Item Number: 2 and was affirmed as a Final Order on November 7, 2008, with respect to a workplace located at: 15320 IH-35 South, Buda, TX 78610.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee in a boom or basket will wear a safety harness with lanyard attached to the basket.
