29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a. On or about January 28, 2013, at the above addressed jobsite, an employee using a chipping hammer (Bosch 11316EVS) was exposed to noise. The employee was not trained in the recognition of jobsite hazards, which included but were not limited to, hearing loss.

29 CFR 1926.101(b): Ear protective devices inserted in the ear shall be fitted or determined individually by competent persons. a. On or about January 28, 2013 - at the above addressed jobsite, an employee exposed to noise using a chipping hammer (Bosch 11316EVS) did not properly don hearing protection. Hearing protection was not fitted by a competent person, thereby exposing the employee to hearing loss.
