29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). a) On or about January 29, 2013; on the north side of the jobsite, the employer allowed employees to utilize a Genie aerial lift (Model:S-60, S/N: N42813) without adequate fall protection in order to perform steel erection activities at a height of approx. sixteen (16) feet.

29 CFR 1926.1412(f)(1): At least every 12 months the equipment must be inspected by a qualified person in accordance with paragraph (d) of this section (each shift) except that the corrective action set forth in paragraphs (f)(4), (f)(5), and (f)(6) of this section must apply in place of the corrective action required by paragraphs (d)(2) and (d)(3) of this section. a) On or about January 29, 2013; on the north side of the jobsite, the employer allowed employees to operate a truck crane (Manitex-M2592) to perform steel erection activities without ensuring that an annual/comprehensive inspection was conducted on the crane at least every 12 months.
