29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access. A) On or about January 29, 2013, and at times prior to, the employer did not provide accessible ladder on a scaffold, exposing employees to fall hazard. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.

29 CFR 1926.651(i)(1): Where the stability of adjoining buildings, walls, or other structures is endangered by excavation operations, support systems such as shoring, bracing, or underpinning shall be provided to ensure the stability of such structures for the protection of employees. A) On or about January 29, 2013 and at times prior to, the employer did not provide stability support system for the scaffold while digging trench, exposing employees to fall hazard. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.
