29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) At the site, on January 28, 2013, where an employee was painting a mural on the side of a building structure from an awning with no fall protection system installed. The awning was greater than ten feet above the ground level. This condition exposed the employee to a fall hazard.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) At the site, on January 28, 2013, where an employee used a ladder that was not extended three feet above the lower landing to access a canopy structure. This condition exposed the employee to a fall hazard.
