On or about January 29, 2013, an employee using a Hitachi NV45AB2 pneumatic air nail gun did not have safety glasses, exposing himself to being hit by nails or flying debris.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a. On or about January 29, 2013, on a 6:12 pitch roof, two employees were not protected from a 10 feet 2-inch fall hazard by use of a guardrail system, safety net system, personal fall arrest system or any alternate fall protection.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    a. On or about January 29, 2013, two employees used 28 foot Werner extension ladder to access a roof that did not extend 3 feet over the eave nor was secured from slippage, exposing themselves to a fall hazard.
