Powered industrial truck operators shall receive initial training in the following topics, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace.      (a) Construction Site - On or about January 29, 2013 employees were exposed to struck by hazard and fall hazard due to the employer not providing powered industrial truck safety training to the operator of a forklift.

29 CFR 1926.100(a):     Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.    (a) Construction Site - On or about January 29, 2013 employees were exposed to falling objects while other employees were working directly above them connecting steel girders with bolts. The employees were not wearing hardhats.

29 CFR 1926.451(g)(1):     Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.    (a)  Center First Beam - On or about January 29, 2013 one employee was exposed to a fall hazard in while standing on the forks of a Caterpillar TH350B Telescopic forklift (serial no. 2993).  The employee was exposed to falling 18 feet 3 inches to concrete.    (b)  Right-side First Beam - On or about January 29, 2013 one employee was exposed to a fall hazard in while standing on the forks of a Caterpillar TH350B Telescopic forklift (serial no. 2993).  The employee was exposed to falling 15 feet to concrete.    (c)  Center of Second Beam - On or about January 29, 2013 one employee was exposed to a fall hazard in while standing on the forks of a Caterpillar TH350B Telescopic forklift (serial no. 2993).  The employee was exposed to falling 18 feet 3 inches to concrete.

29 CFR 1926.760(a)(1):     Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems.    (a)  Middle Beam on Left-side - On or about January 29, 2013 one employee was exposed to a fall hazard while sitting on a steel girder 17 feet above concrete with no guardrail system, safety net system or personal fall arrest system.      (b) Middle of First Beam - On or about January 29, 2013 one employee was exposed to a fall hazard while standing on a steel girder 18 feet 3 inches above concrete with no guardrail system, safety net system or personal fall arrest system.    (c) Middle of Second Beam - On or about January 29, 2013 two employees were exposed to a fall hazard while sitting on a steel girder 18 feet 3 inches above concrete with no guardrail system, safety net system or personal fall arrest ststem.

29 CFR 1926.1053(b)(1):     When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    (a) Right-side of First Steel Beam - On or about January 29, 2013 two employees were exposed to fall hazard while using an aluminum extension ladder that was not extended 3 feet above landing nor was ladder tied to the frame of the building.

29 CFR 1926.1060(a):     The employer shall provide a training program for each employee using ladders and stairways, as necessary. The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.    (a) Construction Site - On or about January 29, 2013 the employer did not train each employee using ladders on how to recognize, minimize and correct fall hazards associated with the use of ladders.
