29 CFR 1926.1101(f)(2)(i) The employer who has a workplace or work operation covered by this standard did not ensure that a "competent person" conducts an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment must be completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly. On January 30, 2013, employees were inside of a Negative Pressure Enclosure performing Class I and Class II asbestos removal and no Initial Exposure Assessment was performed to ensure employees were following the appropriate work practices.

29 CFR 1910.134(m)(2)(i)(C) The employer did not establish a record of the qualitative and quantitative fit tests administered to an employee including specific make, model, style, and size of respirator tested; On February 21, 2013 a document review of the employees fit test records showed the employer failed to record the specific make, model and style of respirator tested on each employee. Employees were using North, 7100 series, half face respirators but no documentation was noted on the fit test record showing employees had been fit tested for a specific make and model for the Powered Air Purifier, Full Face, and Half Face respirators.
