29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening: (a) Employee(s) climbing a fixed ladder to gain access to the first level of the dust collector platform located at the west side of the batch plant were exposed to a fall hazard of approximately 12 feet due to no swing gate being provided for the fixed ladder opening at the top of the platform. (b) Employee(s) climbing a fixed ladder to gain access to the second level of the dust collector platform located at the west side of the batch plant were exposed to a fall hazard of approximately 14 feet due to no swing gate being provided for the fixed ladder opening at the top of the platform.
