29 CFR 1917.95(b)(1)(ii): The employer did not provide and direct the wearing of personal flotation devices for those employees working in physically limited spaces that created a hazard of falling into the water. a) Millard Refrigeration Port - On January 31, 2013 Employees were exposed to drowning hazards from falls into the water, when the employer did not ensure employees were wearing personal floatation devices while loading pallets of chicken boxes onto the Changuinola Bay. The employees were approximately 2 feet away from the edge of the dock bull rail. The two employees were rigging synthetic slings to lift the cargo, and working between and around tripping hazards from cargo being lifted onto the vessel in the water.
