Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to crushing and/or struck-by hazards while employees operate the brake on the rear of a railcar being pushed by a skid steer: (a) On March 26, 2013, employees were exposed to crushing and/or struck-by hazards while manning the brake on the rear of a railcar being pushed by a skid steer because the employer had not established adequate procedures describing where on the platform on the rear of the railcar employees must stand or adequately trained employees on the procedures at the Plains Grain and Agronomy elevator at 119 Fowler Street, Sheldon, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard would be to move railcars by a chain or rope connected to the front of the railcar and a separate rope or chain connected to the rear of the railcar. These two ropes or chains could then be connected to a payloader/tractor at the front and rear to effectively control the movement of the railcar. This method is described in the North Dakota Grain Dealers Association Safety and Health Program, "Railcar Moving and Spotting Guidelines" provided by the employer. Another feasible method is to use a track mobile to move cars on sidings.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: (a) On or about January 18, 2013, for an employee who fell approximately 15 feet from a railcar while performing grain car loading operations without proper fall protection systems in place at the Plains Grain & Agronomy, Sheldon, North Dakota, elevator.
