29 CFR 1904.32(b)(4)(iv): The Summary of Work-Related Injuries and Illnesses (OSHA Form 300A or equivalent) was not properly certified by the immediate supervisor of the highest ranking company official working at the establishment. At the inspection site, for calendar years 2009 through 2011, the OSHA Form 300A Summary of Work-Related injuries and Illnesses presented during the inspection was not certified by the proper official for calendar years 2009 through 2011. Failure to properly certify the 300A Summary is an indication that the OSHA recordable injury and illness history for the recording year may not have been reviewed by the highest management official on site, who is ultimately responsible for preventing employees from being exposed to the same type of injuries and illnesses by ensuring that corrective measures were fully identified during management's evaluation of accidents to prevent similar incidents from happening in the future. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure the OSHA 300A's are certifed by the highest ranking company official at the establishment.

29 CFR 1904.33(a): Basic requirement. The employer did not save the OSHA 300 Log, the privacy case list (if one exists), the annual summary OSHA 300A, and the OSHA 301 Incident Report forms for five (5) years following the end of the calendar year that these records cover. At the inspection site, for calendar years 2009 through 2011, a certified copy of the OSHA Form 300A Summary of Work-Related Injuries and Illnesses was not retained on file at the premises. Failure to properly certify, maintain, and be able to provide the signed 300A Summary forms is an indication that the OSHA recordable injury and illness history for the recording year may not have been reviewed by the highest management official on site, who is ultimately responsible for preventing employees from being exposed to the same type of injuries and illnesses by ensuring that corrective measures were fully identified during management's evaluation of the accident to prevent similar accidents from happening in the future. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure a signed, certified copy of the OSHA 300A summary is kept on site for a period of five (5) years.
