29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    The employer does not ensure that employees wear eye protection when operations present potential eye injury hazards. This violation was observed on or about February 1, 2013, at the construction site when an employee was exposed to a stuck-by hazard while operating a nail gun without wearing eye protection.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees are provided with and required to use personal protective equipment needed to protect against hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).    The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed on or about February 1, 2013 at the construction site where an employee was exposed to a 10 ft. fall hazard when performing roofing work without fall protection.      JOSE ANTONIO DELGADO WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(b)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 470078, CITATION NUMBER 1, ITEM 1 ISSUED ON JUNE 21, 2012, WITH RESPECT TO A WORKPLACE LOCATED AT 5531 FLORAL VALLEY LN, KATY, TX 77449.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when exposed to falls 6 feet or more above a lower level or ground.
