29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed on or about February 1, 2013 at the construction site where employees were exposed to a 20 ft. fall hazard when performing roofing work without fall protection. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected from falling.

29 CFR 1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigid support. The employer does not ensure that ladder used by employees is extended 3 feet above the upper landing surface. This violation was observed on or about February 1, 2013 at the construction site where employees were exposed to a 10 foot fall hazard when using a ladder that its side rails did not extend to at least 3 feet above the upper landing surface to which the ladder was used to gain access and was not secured at its top to a rigid support. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that ladders used by employees have the ladders side rails extended at least three feet above the upper landing surface and secured its top to a rigid support.
