29 CFR 1926.651(j)(1): Employer did not ensure adequate protection was provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face. Such protection shall consist of scaling to remove loose material; installation of protective barricades at intervals as necessary on the face to stop and contain falling material; or other means that provide equivalent protection: On February 1, 2013, and at times prior thereto, at a site located parallel to the frontage road and I-20 in Midland, Texas 79707. The employer did not ensure was benched and shored to protect employees from loose rock and soil falling in on them. Exposing employees to engulfment hazards.
