29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. On or about 1/29/2013, at the Buford jobsite, employees were exposed to fall hazards over 18' on residential roof slopes that were greater than 4 in 12 and were not using any fall protection. No abatement certification or documentation is required for this item.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. On or about 1/29/13, the employer has not created a fall protection training program for employees exposed to fall hazards at various job sites. Employees have had fall protection equipment in the past but have not been trained on that equipment and it's use is not enforced by the employer. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
