29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: (a) On or about 01/24/13, at the North Ponds Village Senior Development, located on 822 Holt Road, in Webster, New York, a 3M 8511 respirator was in use without an effective seal due to facial hair. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.134(k)(1)(i): The employer did not ensure that each employee could demonstrate knowledge of why the respirator was necessary and how improper fit, usage, or maintenance could compromise the protective effect of the respirator: (a) On or about 01/24/13, at the North Ponds Village Senior Development, located on 822 Holt Road, in Webster, New York, 3M respirators were in use by individuals who could not demonstrate knowledge of ensuring proper fit.
