29 CFR 1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer: On or about May 7, 2013, an employee transferring silica sand from railcars was exposed to respirable dust at an eight hour time weighted average of 12.323 mg/m3, which is above the permissible exposure limit of 5 mg/m3. The company did not have a respiratory protection program.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d): On or about May 7, 2013, feasible administrative and engineering controls had not been determined and implemented, and the use of respiratory protection was not enforced when employees were exposed to respirable dust at levels above the permissible exposure limit. Controls usually effective in these circumstances include but are not limited to the following: 1. Isolation of the hazard from employees by means of a barrier or enclosure. 2. Maximizing the distance between the hazard and employees. 3. Ensuring that respiratory protection is worn while exposed to the hazard.
