29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace in a manner that would reasonably estimate the employee's exposure.    a) On or about February 5, 2013, at the New Johnsonville Marine, 10719 Old State Rt 1, New Johnsonville, TN, employees were exposed to respirable dust while welding steel materials during barge fabrication procedures and no exposure monitoring had been conducted that could be relied upon to reasonably anticipate the employees exposure. An 8 hour time weighted average sample revealed employee over exposure to respirable dust, from welding fumes, at 20 mg/m3 in apparent violation of 29 CFR 1910.1000.  This is 15 mg/m3 above the PEL mandated by the standard.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    (a) On or about February 5, 2013, at the New Johnsonville Marine, 10719 Old State Rt 1, New Johnsonville, TN the employer required its employees to wear N-95 respirators during welding procedures without ensuring that employees are medically capable to use the respirator and that the respirator is maintained and used in a manner that does not present a health hazard to the user. Respirable dust monitoring results indicated an exposure result of 20 mg/m3 (29 CFR 1910.1000 PEL = 5mg/m3) during welding proceses. 29 CFR 1910.1000 does not cover maritime operations, the employer requires the use of N95 respirators during welding operations and therefore needs to implement the requirements of a respiratory protection program.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
